The RCFP argues that settling the case would have a chilling effect on free speech and the ability of filmmakers to portray public figures. The scene in question reportedly depicts Trump raping his first wife, Ivana, an allegation she made during their divorce proceedings but later recanted. Trump's lawsuit claims the scene is false and defamatory, while the film's director, Ali Abbasi, maintains it is based on widely reported accounts.
