The Supreme Court of India ruled on April 20, 2023, that Direct-to-Home (DTH) service providers are liable to pay both service tax and entertainment tax, overturning a previous decision by the Uttarakhand High Court. The court clarified that DTH services fall under the category of services as per the Finance Act of 1994, and thus, are subject to service tax. Additionally, the court upheld the applicability of entertainment tax as per the local laws of Uttarakhand, stating that the nature of DTH services does not exempt them from this tax.
